How to tell your employer
The law is specific about when and what. Get both right and your employer has very little room to argue about the dates. Here is the rule, then a letter you can send today.
The 10 week rule
Give written notice at least 10 weeks before you want the leave to start. If the timing makes that impossible, give as much notice as you can and say why. Then, at least 4 weeks before the start date, confirm the dates or tell them what has changed.
The notice has to say:
- the day you want the leave to start and the day it will end, or how long it will run
- whether you want to take any of it as single flexible days, and how many
- that it is unpaid parental leave under the National Employment Standards
Your employer can ask for evidence, usually a medical certificate showing the expected date of birth. They cannot refuse the leave if you are eligible. They can only refuse an extension beyond 12 months, and only on reasonable business grounds, in writing.
Timing that works for most people
- By 10 weeks out. Send the letter below. Keep the dates a little loose and say you will confirm.
- By 4 weeks out. Confirm the start date and how many single days you plan to use.
- Up to 3 months before the due date. Lodge your Parental Leave Pay claim with Services Australia. You do not need your employer's permission for the claim.
- After the birth. Send proof of birth to Services Australia. Your employer is told which days you are being paid for.
Things worth knowing before the conversation
- Your 12 months are yours. They do not come out of your partner's leave, whatever the manager has heard.
- Up to 130 of those days can be single days spread over the first 24 months. Say up front if you plan to use them.
- Under 12 months with this employer? The Act does not guarantee the leave, but ask anyway. Many agreements and most reasonable managers say yes.
